Terms of Service

Welcome to Sawari! These Terms of Service ("Terms") govern your use of the Sawari mobile application (the "App") developed by Zijun Fang ("we", "our", or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using Sawari, you agree to comply with and be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the App.
2. License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use Sawari for personal, non-commercial purposes in accordance with these Terms.
You May:
- Use the App to tune your shamisen or other instruments
- Access all features included in your subscription tier
- Use the App on devices associated with your Apple ID
You May Not:
- Modify, reverse engineer, or decompile the App
- Remove or alter any copyright, trademark, or proprietary notices
- Use the App for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to any portion of the App
- Distribute or make the App available over a network where it could be used by multiple devices at the same time
3. Microphone Access
Sawari requires access to your device's microphone to provide pitch detection and tuning functionality. By granting microphone access, you acknowledge that:
- Audio is processed in real-time on your device only
- No audio data is recorded, stored, or transmitted
- You may revoke microphone access at any time through device settings, though this will disable the tuning feature
4. In-App Purchases and Subscriptions
Purchase Terms
Sawari offers in-app purchases to unlock premium features. All purchases are processed through the Apple App Store and are subject to Apple's Terms of Service. Purchase data stays entirely within Apple's ecosystem and is never shared with us or any third party.
Subscriptions
- Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Cancellation: You can cancel subscriptions at any time through your Apple ID account settings
- Refunds: Refund requests are handled by Apple according to their refund policy
- Price Changes: We reserve the right to modify subscription prices with advance notice
Free Features
The free version of Sawari may include advertisements and limited features. Premium subscriptions remove ads and unlock additional tuning modes and features.
App Tracking Transparency
On first launch, Sawari will present Apple's App Tracking Transparency (ATT) prompt. This determines whether ads are personalized. You can change this preference at any time in Settings > Privacy & Security > Tracking.
5. Acceptable Use
You agree to use Sawari only for lawful purposes. You are responsible for your use of the App and any consequences thereof.
6. Intellectual Property
All content, features, and functionality of Sawari, including but not limited to text, graphics, logos, software code, and algorithms, are owned by Zijun Fang and are protected by international copyright, trademark, and other intellectual property laws.
7. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We do not guarantee that:
- The App will be error-free or uninterrupted
- Defects will be corrected
- The App is free of viruses or other harmful components
- Results obtained from using the App will be accurate or reliable
8. Limitation of Liability
To the maximum extent permitted by law, Zijun Fang shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the App
- Any unauthorized access to or use of our servers
- Any bugs, viruses, or other harmful code transmitted through the App
- Any errors or omissions in content
9. Indemnification
You agree to indemnify and hold harmless Zijun Fang from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the App or violation of these Terms.
10. Privacy
Your use of Sawari is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices.
11. Termination
We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions.
14. App Store Terms
Your use of Sawari must comply with the App Store Terms of Service. In the event of conflict between these Terms and the App Store Terms of Service, the App Store Terms of Service shall prevail.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
